'You' refers to the user.
'WeGene' refers to Shenzhen Zaozhidao Technology Co., Ltd., including genetic testing, service, technical teams and related parties.
'Service' refers to the products, software, services and websites provided by WeGene, including (but not limited to) text, graphics, images and other material and information, as well as any versions and content updates.
'Personal information' refers to the information that identifies individual users, including user registration information, personal genome information, report content and network behavior information.
Before receiving our services, you need to accept and agree to all the terms of service.
Acceptance means you are accepting the entire content of the Agreement. Please read the Agreement carefully before accepting the terms of service. People under the age of 18 are required to make acceptance under the supervision of their guardians. Any future products and services of WeGene will also be restricted by corresponding new agreement.
You need to accept this Service Agreement voluntarily or you can apply for withdrawal following the provisions of the Agreement. In light of this Agreement, we protect your safety, health and rights.
For users over the age of 18: Responsible for their actions; Understand the Service Agreement and the corresponding Informed Consent; Accept the Service Agreement and the corresponding Informed Consent voluntarily.
For users under the age of 18: Accept the Agreement with the consent and knowledge of their legal guardians; Users or their legal guardians are responsible for all information and comments provided to WeGene. Accept the Service Agreement and the corresponding Informed Consent voluntarily.
With the continuous development and changes of the service items, we are not obliged to inform you in advance of the updates or project versions that will be produced. You have the right to stop the service at any time without special notice unless you apply for closing your account at WeGene. WeGene is not responsible for anything beyond the scope of this Agreement or related terms.
As for the network resources required to receive the service, users need to have access to the internet and applicable equipment.
We cannot guarantee to provide complete information in all of our services. With the progress and development of scientific research, you may need to actively obtain more information through the updated WeGene service or relevant doctors, genetic counselors or other health care professionals. WeGene encourages you to communicate with relevant doctors or genetic counselors, which may help you better interpret the relevant results and understand the accuracy and suitability of the results for yourself. For concerns and the psychological burden of genetic testing results, we recommend you consult with professionals before receiving our service.
WeGene's genetic testing results may be out of your expectations. You should not assume that any information provided to you, whether now or as genetic research advances, will be welcome or positive. For example, you may have an above-average risk for a particular disease compared to the population, which may cause some psychological discomfort to you or even influence your social, legal, economic and health. WeGene is not responsible for these circumstances.
Disease risk and disease occurrence are not in a direct relationship. Factors such as the environment, mental state and diet may contribute to the occurrence or development of disease. Also, future research may make conflicting discoveries in disease occurrence and genetic predisposition.
We remind you to protect your genetic information. You should be cautious about sharing genetic information with other people or organizations, as the leakage of your genetic information may affect your interests in insurance or employment. You can consult professional lawyers if you are concerned. Personal genetic information can provide some informative message, but is not completely equivalent to professional medical advice.
Because the original genetic data file you uploaded for analysis comes from a third-party genetic testing provider other than WeGene, we cannot guarantee its accuracy in all genetic information and we are not responsible for the quality and accuracy of such data. When WeGene uses this data for computational analysis and generates reports, we will assume that the genetic data you upload is accurate.Due to the different range of loci detected by high-throughput microarray or sequencing data provided by different genetic testing providers, the report we finally generate for you may change in terms of interpretation of the project compared with the documents issued by other third-party testing providers. If our system detects that the data file you uploaded does not meet the requirements of our report, you may receive a notification including the information about the unavailable reports or the accuracy of some reports may be affected after you upload your original genetic data file. Before using this service, you need to accept our Agreement on privacy statements. Please click 'Agree' in the Service Agreement (including the corresponding Informed Consent) on the related service webpage to execute our corresponding services. That is, once the service is performed, it indicates that you have accepted the relevant Service Agreement and the corresponding Informed Consent.
You agree to our staff's routine maintenance, management and commissioning of the system. In addition, the summary of genetic information and reports can be used by scientific research institutions, the publication of scientific research articles, the improvement of clinical treatment methods, drug research and development, the development of diagnostic monitoring equipment or relevant third-party institutions. However, WeGene will not disclose your personal genetic information to any third party without your consent or special legal circumstances.
We have the obligation to protect your privacy and you also know that we have the right to provide your personal information if required by the judicial system or relevant regulations, in which case WeGene will also give corresponding notice. You know that data information can spread across networks in various forms and can be adapted to different device environments. Except for unexpected network attacks, WeGene will strictly restrict network access.
You should understand that WeGene aims to provide the public with products and services based on the latest scientific discoveries in genetics and bioinformatics and may use these data to support scientific research, medical research and development, development of related scientific and technological products, etc. WeGene's services are not intended to diagnose any condition or disease. The genetic tesing results should not be applied in any diagnostic or medical purposes.
The genetic data you uploaded must be authorized data. WeGene assumes no responsibility for the authenticity of the data or the legitimacy of the source.
Users over the age of 18 or the legal guardian of users under the age of 18 accept all the terms of this Agreement.
Scope of service: WeGene provides interpretation and follow-up services to all users with their own genomic data around the world. WeGene will provide you with analytical services following legal restrictions in mainland China.
Once you have uploaded the data to WeGene and paid to start data analysis, the fees will be non-refundable.
WeGene's genetic report is evidence-based, you can always find corresponding sources and references. Your genetic report is not equivalent to clinical diagnosis or treatment.
Account security is a very important aspect of your privacy. In case of security issues such as unauthorized use of your account, please contact WeGene immediately. You are fully responsible for the risk caused by the disclosure of personal account information.
Shenzhen Zaozhidao Technology Co., Ltd. holds full ownership of the commercial value and scientific research output generated by the biometric samples, genetic or phenotypic information provided by individual users.
If you violate the terms of this Agreement, WeGene will also have the right to refuse to provide you with any form of service at this stage or in the future and you will also be responsible for the labor, expenses or any losses incurred to WeGene.
You guarantee that the information you provided is true, valid, complete and with time effect. If you deliberately provide untrue information, we have the right to question and stop providing services. You are obliged to keep the information registered on WeGene's websites confidential. If you intentionally disclose the account information and cause losses to you or WeGene, we will not be responsible and have the right to claim corresponding compensation from you.
At this stage, WeGene's sales channels include the company's official website (www.wegene. com) and authorized sales channels.
If products and services are purchased through unauthorized channels, we cannot guarantee the provision of the full scope of services. If invalid products and services are purchased through other channels, we have the right to refuse to provide any service or any processing of transaction that occurred.
Except for the partners or promotional activities officially authorized by WeGene, you shall not resell our products, services and any related content in any form, including website information, content design, report content, etc.
Shenzhen Zaozhidao Technology Co., Ltd. may terminate the Service Agreement with you under the following circumstances:
1. As required by laws and regulations.
2. You have violated the Service Agreement or related Agreements.
3. The authorized third-party ceases to provide services to you.
4. Product or service you purchased from WeGene no longer exists.
If you want to close WeGene's account for any personal reason, please inform us via E-mail (service@wegene.com) using the registration E-mail linked to WeGene's account, along with application statement and description. We will close the account after confirmation.
Upon acceptance of the Agreement, both parties (you and WeGene) shall fully and properly perform all obligations under the Agreement. Any party who fails to perform the Agreement or the performance is not in conformity with the Agreement, shall be liable for breach of contract.
The execution, effectiveness, construction, performance, amendment and termination of this Agreement and the resolution of disputes hereunder shall be governed by the laws of the People's Republic of China.
In the event of any dispute for the construction and performance of this Agreement, the parties shall first resolve the dispute through friendly negotiations. In the event the parties fail to reach an agreement on the dispute, either party may submit the relevant dispute to a local People's Court. The arbitration shall be conducted in Shenzhen, the People's Republic of China. The language used in the arbitration shall be Chinese. The arbitration award shall be final and binding on all parties.
